General Terms and Conditions of Sale – My Shank S.A.S
These terms and conditions of sale are entered into by:
* The company My Shank S.A.S, whose registered office is located at 6 Kerliverien, 29170 Pleuven, France, registered with the Trade and Companies Register of Quimper under number 82093249900016, hereinafter referred to as "My Shank";
* And any natural or legal person wishing to make a purchase via the website [www.myshank.com](http://www.myshank.com), hereinafter referred to as "the buyer".
Article 1 – Purpose
In case of discrepancy between this translation and the original French version, the French version shall prevail.
These terms define the contractual relationship between My Shank and the buyer, whether acting as a consumer or professional, as well as the applicable conditions for any purchase made through the website myshank.com.
Purchasing a product or service from this website constitutes full and unconditional acceptance of these general terms and conditions of sale. These conditions prevail over any other general or special terms not expressly approved by My Shank.
My Shank reserves the right to modify these terms and conditions at any time. The applicable terms are those in effect at the time the order is placed.
In case of discrepancy, the French version of the Terms and Conditions shall prevail.
Article 2 – Products and Services
The products and services offered are those listed in the online catalog on the My Shank website, subject to availability.
Product photographs are as accurate as possible but may not be perfectly identical to the actual product, particularly in terms of color or texture.
Article 3 – Prices
Prices are listed in euros, including VAT. Any change in the VAT rate may be reflected in the product prices. Prices may be changed at any time, but the applicable price will be the one in effect on the date of order confirmation.
Prices do not include handling, packaging, or shipping fees, unless otherwise stated.
Article 4 – Geographic Scope
Online sales are available to buyers residing in Europe. For orders from outside Europe (Africa, Middle East, Asia), prior contact with My Shank is required.
Article 5 – Orders
The buyer must:
* Provide identification details
* Complete the online order form with all product or service references
* Review and confirm the order
* Make payment as specified
Order confirmation constitutes full and unconditional acceptance of these terms and conditions, acknowledgment of having read them, and waiver of any other purchasing conditions.
My Shank reserves the right to refuse any order that is manifestly incoherent, fraudulent, contrary to the normal use of the products, or resulting from abusive behavior. Refusal may also apply in the case of prior disputes or documented misconduct or bad faith on the part of the buyer.
Article 6 – Retention of Ownership
In accordance with Law 80-335 of May 12, 1980, My Shank retains full ownership of the goods sold until complete payment of the invoiced amount. Upon delivery, the buyer assumes all responsibility for any damage to or caused by the goods.
Article 7 – Payment
Payment is due upon ordering. It may be made by credit card, PayPal, or check. Online payments are secured via the SSL protocol through PayPal.
The buyer’s account will only be charged upon shipment of the products or services.
An invoice including VAT will be provided upon request.
Article 8 – Delivery
Deliveries are made to the address provided in the order form, which must fall within the geographical area agreed upon.
The buyer is fully responsible for providing a correct delivery and billing address. A second shipment due to address error will incur additional shipping charges.
The risks are transferred to the buyer once the goods have left the premises of My Shank. In case of damage during transport, the buyer must issue a formal complaint to the carrier within three days of delivery.
Any change of address must be communicated by email and confirmed in writing. Delivery times are provided for information purposes only.
Article 9 – Receipt of Items for Repair
Any stylus or item sent for repair must be shipped with tracking and delivery confirmation by signature. My Shank is not liable for items lost in transit without signed proof of receipt.
Article 10 – Warranty
Products are covered by the legal warranty against hidden defects (Articles 1641 and following of the French Civil Code) and the legal warranty of conformity under Articles L217-3 to L217-20 of the French Consumer Code.
In accordance with this warranty, the consumer has two years from delivery to request repair or replacement free of charge in the event of non-conformity.
All claims must be made within seven days of delivery. No refund will be granted for sound defects resulting from a non-compliant master. Defective products may be exchanged or refunded after return and inspection in our workshop.
Article 11 – Liability
My Shank is bound only by a best-efforts obligation in the online sales process. It cannot be held liable for any indirect or intangible damages such as data loss, service interruption, viruses, or other unintended issues.
Article 12 – Intellectual Property
All content on the [www.myshank.com](http://www.myshank.com) website is protected by intellectual property laws. Any reproduction or use, even partial, is prohibited without express written authorization.
Article 13 – Personal Data
My Shank processes personal data in accordance with the General Data Protection Regulation (GDPR – EU 2016/679). Users may request access, rectification, or deletion of their personal data by emailing [info@myshank.com](mailto:info@myshank.com).
Article 14 – Archiving – Proof
Orders and invoices are archived on reliable and durable media. They serve as valid proof of transactions between the parties.
Article 15 – Refusal of Sale
My Shank reserves the right to refuse any order or to terminate a commercial relationship with a buyer in the event of incoherent ordering behavior, inappropriate conduct, or prior disputes. This refusal may be immediate and without notice, particularly in cases of unjustified partial purchases or attempts to misuse products.
Article 16 – Disputes
These terms and conditions are governed by French law. In the event of a dispute, jurisdiction is granted to the competent courts of Quimper, France, even in cases involving multiple defendants or third-party claims.
